Terms and Conditions
General:
Unless otherwise stated, this quote assumes the below and any deviations from the below terms will incur additional charges
- The customer is required to provide clear and reasonable unobstructed access to install areas (please note that we will not move furniture/window coverings or any other items to gain access to install area).
- Waiting times exceeding one hour to gain access to site may result in the need to reschedule the works or incur a variation charge.
- A builders clean has been completed prior to our installers arriving on site ensuring a clean and dust free environment. We reserve the right to cease works on site due to inadequate installation conditions. If installers are requested to work despite site conditions you will be requested to sign a waiver form accepting liability for any possible defects.
- Any unavoidable additional works required on the day (e.g. film removal) will be charged for as a variation cost.
- That work is to be carried out within normal hours – between 7.00am and 3.00pm Monday to Friday (please note there may be an extra charge for work completed outside of these hours).
- Any urgent work after an already agreed upon lead time will incur additional fees.
- Formul8 is not liable for delays or non-performance resulting from circumstances beyond our control, including but not limited to natural disasters, strikes, global supply chain disruptions, or government restrictions.
- Formul8 reserves the right to photograph completed works for portfolio and promotional purposes unless otherwise agreed in writing.
Quotation Approval:
- Quotations are valid for 30 days.
- A quotation is deemed accepted upon receipt of a Purchase Order, deposit payment, or digital acceptance via email confirmation. Any of the listed approval methods is an acknowledgement of accepting our terms and conditions.
Payment Terms:
- Unless otherwise agreed in writing, new customers are required to pay the full invoice balance upon completion of the project.
- Regular customers will be required to complete an account application form where payment terms will be outlined and confirmed.
- Retention clause – goods supplied remain the property of Formul8 until the account is paid in full.
- Late payments will incur a fee of 2% of the total contract value per month on overdue balances, repeated delays may result in withdrawal of any pre-approved credit accounts or payment terms.
Installation:
- If the site is not ready for installation of works upon our scheduled arrival, a fee of $1,000 per installer allocated will be charged. We reserve the right to not return to site until this fee is paid.
- For out-of-frame application, we cannot accept responsibility for damage to glass or film during handling or transportation.
- Once a job has been booked in, any cancellation less than 24 hours prior to scheduled booking, will incur a charge of $1,000. This fee covers administrative, installation and scheduling costs incurred due to the disruption. Rescheduling will be subject to availability and may result in delays.
- Any new glazing must be caulked and allowed to dry for 72 hours prior to film installation.
- If the job is cancelled by the customer after quote approval any administration and manufacturing costs that have occurred will be charged accordingly. Any materials already manufactured can be supplied to customer upon request.
- External installs are subject to environmental conditions inclusive of (but not limited to) rain, wind, high and low temperatures. Scheduling is subject to change for safety and quality assurance. By proceeding, the client acknowledges this risk.
Delivery:
- Acceptance of delivery of glass or materials from our factory is acknowledgement that the goods are in satisfactory condition.
- Pick or delivery of any glass must be arranged by the customer unless otherwise agreed upon.
Visual Quality Standards:
- Acceptance of this quotation is a recognition that we are working within the parameters of the WFAANZ Visual Quality Standards. These standards are available upon request or via Formul8 website.
Artwork Requirements:
- All artwork must be provided in AI, EPS or PDF format. Vectorized artwork preferred. Any non-vectorized artwork will incur an artwork design fee.
- Any specialised fonts must be provided by the customer or will be charged for accordingly.
- Any creation or manipulation of artworks will be charged at $100 plus GST per hour.
- If artwork is required before quote acceptance an upfront fee will be charged. This charge may be waived if works go ahead.
- We will include two revisions in our artwork costings. Any revisions after this will be charged at an hourly rate.
- Please provide a Pantone reference or a physical colour sample. We will match it as closely as possible and supply a sample print for your approval prior to commencing production.
- We will not guarantee colour matching of our previously printed film/signage to be replaced more than three months after the job completion.
Lead Times/Material Procurement:
- Before material procurement and manufacturing can proceed shop drawing approval is required.
- All manufacturing lead times begin from final shop drawing (or sample if required) approval.
- Any delays caused by material procurement may affect lead times to which you will be notified if we can’t accommodate agreed due date.
- Unless otherwise specified in the approved shop drawings, standard lead times apply.
- If a specified material becomes unavailable, Formul8 reserves the right to propose an equivalent alternative for customer approval prior to fabrication.
Damage Disclaimer:
- All care will be taken, but we cannot accept responsibility should any glass crack or incur damage when we remove existing film or signage.
- All possible considerations are undertaken to avoid the event of glass failure. However, the application of some films will increase the solar absorption within the glass pane and should there be a pre-existing flaw within the pane edge, the risk of thermal fractures increases.
We will recommend the most suitable and low risk products with the information we are provided. We cannot accept responsibility for damage to the glass from the thermal stress once the film has been applied.
Film Care & Maintenance:
- Please refer to our Pre & Post Product Install Maintenance Guide fact sheet for more tips on how to clean and maintain your new film, graphics or signage. In the case of specialty films or signage specific film care and guidelines can be provided. This guide is available upon request or via Formul8 website.
Manufacturing Warranty:
- All Formul8 products have a standard 12-month limited warranty.
- Formul8 utilises a range of window films and wall coverings supplied by a range of manufacturers, therefore warranty periods are dependent on the product installed. These can be provided upon request.
Installation Warranty:
- Formul8 installation warranty period is valid for a period of 12 months after installation. This warranty does not apply to deliberate or accidental damage occurring after installation.
- Some films that are installed externally on the glass will not be covered under warranty.
- Glass breakage or failure is not covered under this warranty.
- Film installed in rooms with extreme moisture / heat conditions will not be covered under our warranty.
Extended Warranty:
Extended warranty options may be available depending on the product or installation type. Please speak with your account manager prior to quote acceptance.
Dispute Resolution:
In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If unresolved, mediation through an agreed third party will be pursued before legal action.
Limitation of Liability:
To the fullest extent permitted by law:
- 2ndGen Pty Ltd (trading as Formul8) shall not be liable for any indirect, incidental, special, or consequential loss or damage, including but not limited to loss of profits, revenue, business opportunities, or data, arising out of or in connection with the supply, manufacture, or installation of goods or services, even if advised of the possibility of such damages.
- Our total liability for any claim, whether in contract, tort (including negligence), under statute, or otherwise, shall not exceed the total amount paid by the customer for the specific goods or services giving rise to the claim.
- We accept no liability for:
- Delays caused by third parties, weather conditions, or site inaccessibility.
- Damage to glass or surfaces where pre-existing faults or conditions exist.
- Colour variations due to environmental exposure or differences in material batches.
- Any work performed outside of our standard installation conditions or without adherence to our care and maintenance guidelines.
- Nothing in this clause limits any rights the customer may have under the Australian Consumer Law or other applicable legislation that cannot be excluded or modified by contract.
To lodge a warranty claim, the customer must provide a copy of the job invoice as proof of purchase or installation. Failure to present this documentation may result in the claim being void.
